TERMS AND CONDITIONS

These Terms and Conditions shall apply to all orders for water delivery by and between EastTNWaterDelivery.com, LLC and the customer placing the order by any means, electronic or verbal.

These Terms and Conditions shall be deemed to be a part of each order for water delivery. 

No Representations or Warranties: EXCEPT AS EXPRESSLY SET FORTH HEREIN, EastTNWaterDelivery.com, LLC MAKES NO WARRANTY WITH RESPECT TO THE SERVICES AND EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS, OR OTHER TERMS, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION, WARRANTIES REGARDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DESIGN, CONDITION, CAPACITY, PERFORMANCE, TITLE AND NON-INFRINGEMENT. 

Payments: 

Customer shall pay all amounts owed with respect to each order to EastTNWaterDelivery.com, LLC

Amounts owed hereunder for services may include the following:

Per-load charge for water is non-refundable and non-returnable once delivery has commenced.

All payments are due upon delivery  

If an invoice is not paid within seven (7) days after the due date, a late fee of five percent (5%) will be added on the eighth (8th) day after the due date and every 30 days thereafter until the invoice (including all accrued late fees) is paid in full. 

If a balance becomes delinquent or unrecoverable by EastTnWaterDelivery and the matter must be brought to a court hearing, customer agrees to pay for East TN Water Delivery's attorney fees.

THIS IS A RELEASE, WAIVER AND SAVE HARMLESS AGREEMENT AND BY SIGNING THIS DOCUMENT YOU ARE RELEASING CERTAIN LEGAL RIGHTS AND CLAIMS. BY SIGNING THIS DOCUMENT, YOU ACKNOWLEDGE YOU HAVE READ THE FOREGOING AGREEMENT AND FULLY UNDERSTAND IT AND INTEND TO BE BOUND BY IT
